These Terms and Conditions apply to all services provided by Comfy Air within Spain.

2. Scope of Services

Comfy Air provides professional air conditioning hygiene cleaning and basic maintenance services for residential and small commercial properties.

Services may include:

  • Cleaning of indoor AC units

  • Cleaning of outdoor condenser units

  • Hygiene treatment

  • Basic visual inspection

  • Photo documentation (where applicable)

Services do not include:

  • Mechanical repairs

  • Refrigerant refilling

  • Electrical rewiring

  • Replacement of defective components

  • Technical certification

Unless explicitly agreed in writing.

3. Pricing & Payment Terms

All prices are stated in Euros (€) and exclude IVA (VAT) unless otherwise specified.

3.1 Annual Maintenance Program (3-Year Agreement)

  • First indoor + associated outdoor unit: €100

  • Each additional indoor unit: €50

  • Each additional outdoor unit (beyond first): €25

Payment terms:

  • Year 1 invoiced prior to first service.

  • Year 2 and Year 3 invoiced annually before scheduled service.

3.2 One-Time Service

  • First indoor + associated outdoor unit: €120

  • Each additional indoor unit: €60

  • Each additional outdoor unit (beyond first): €30

Payment is due within 7 days of invoice date unless otherwise agreed.

Late payments may result in statutory interest and recovery costs in accordance with Spanish law.

4. Scheduling & Property Access

The client must:

  • Ensure safe and unobstructed access to all units

  • Ensure electrical supply is available

  • Secure pets during service

  • Inform Comfy Air of any known technical issues

If access is not possible at the scheduled time, Comfy Air reserves the right to charge a call-out fee.

Appointments may be rescheduled with at least 24 hours’ notice.
Cancellations within 24 hours may incur a service fee.

5. Client Responsibilities

The client confirms that:

  • The AC system has been legally installed

  • The installation complies with applicable regulations

  • No hazardous materials are present

  • Units are structurally safe to access

Comfy Air is not responsible for damages resulting from unsafe installations or hidden defects.

6. Service Limitations

Cleaning improves hygiene and may enhance airflow and efficiency. However, Comfy Air does not guarantee:

  • Repair of mechanical defects

  • Elimination of all odors

  • Prevention of future breakdowns

  • Compliance with manufacturer warranty conditions

Any identified technical defects will be communicated separately and may require third-party repair.

Cleaning services do not constitute a technical inspection or safety certification unless explicitly agreed in writing.

7. Liability

7.1 Limitation of Liability

Comfy Air’s total liability, whether arising from contract, negligence, or otherwise, shall be strictly limited to:

The total amount paid by the client for services in the twelve (12) months preceding the claim.

Under no circumstances shall liability exceed this amount.

7.2 Exclusion of Indirect Damages

Comfy Air shall not be liable for:

  • Indirect or consequential damages

  • Loss of rental income

  • Loss of business revenue

  • Loss of profits

  • System downtime

  • Increased energy costs

  • Claims from tenants or third parties

Even if Comfy Air has been advised of the possibility of such damages

7.3 Pre-Existing Conditions

Comfy Air is not liable for:

  • Pre-existing defects

  • Corrosion, leaks, electrical faults

  • Improper installation by third parties

  • Age-related deterioration

  • Hidden structural issues

7.4 Force Majeure

Comfy Air shall not be liable for delays or failure caused by circumstances beyond reasonable control, including:

  • Extreme weather

  • Power outages

  • Supplier failure

  • Government restrictions

  • Restricted property access

7.5 Mandatory Legal Liability

Nothing in these Terms excludes or limits liability where such limitation is not permitted under applicable Spanish law, including cases of gross negligence (negligencia grave) or intentional misconduct (dolo).

8. Annual Maintenance Agreement Conditions

Annual Maintenance Agreements:

  • Run for a fixed period of 3 years

  • Are invoiced annually

  • May be transferred to a new property owner

Early termination requires written agreement by both parties.

Failure to pay invoices may result in suspension of service.

9. Data Protection

Personal data is processed in accordance with applicable Spanish data protection laws and the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for full details.

10. Governing Law & Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of Spain.

Any disputes shall be submitted to the competent courts in the province where the service is performed, unless mandatory consumer protection regulations require otherwise.
